What Is Life Insurance?
Life insurance is a contract that pledges payment of an amount to the person assured (or his nominee) on the happening of the event insured against :

Google Translator Utilities

                                                     
One of my friends came to me for getting a lengthy Legal Agreement translated into HINDI after exhausting all his efforts. I thought that it should not be a difficult task in Today's technical world. I immediately checked up with Google Translator and there was an immediate solution to solve the PROBLEM.

Working with Google Translator Utility for immediate online translation into approx 60 languages and vice verse is reproduced below for the benefit of My Readers and Public in General :

Step 1: Sign in to  Google Translator with your GMAIL ID.

Step 2: Manually type the document in any language in the box on the left side to get translation in the desired language in the box on the right side.

Alternatively, you can upload (Copy and Paste)  the document in the left side box. Google translator will not only TRANSLATE the document but also :

i) Detect the original language of the original document.

ii) Keep records of all your such documents translated so that you can archive the ORIGINAL DOCUMENTS at a future date so as to clarify any doubt or legality of the document translated.

5. Don't miss the sunscreen even if the day is cloudy. UV rays can penetrate the clouds.
6. Shun heavy makeup - you don't want raccoon eyes if caught in the rain.
7. Use water-proof makeup, if you must.
8. Opt for a light mousse, a matte compact or just a few drops of calamine lotion mixed with your moisturizer as a makeup base.

Mobile Number Portability - Customer guide for availing facility

  • Contact the new mobile service provider to whom you want to port your mobile number.
  • Obtain Customer Acquisition Form (CAF) & Porting Form.
  • Read the eligibility, probable reasons for porting rejection and other conditions carefully.
  • If eligible, fill up the CAF and Porting Form.  For filling up of porting form you need a ‘Unique Porting Code’ (UPC)
  • To obtain UPC send SMS from the mobile number you want to port to the number ‘1900’ with text ‘PORT’ followed by space followed by your 10 digits mobile number you want to port.  ( As pre-paid SMS is not permitted, in Jammu & Kashmir the subscriber has to dial ‘1900’ to get a UPC, the operator at ‘1900’ provide the UPC after verifying subscriber number with CLI. )
  • It may be noted that you will receive an auto-generated 8 digits UPC from the Donor operator. The first two characters of the UPC consist of ‘Alphabets’ and the remaining 6 digits will be numerical characters except zero.  The UPC is valid for 15 days (30 days in case of J&K, NE & Assam Service Areas). 
  • Submit the duly filled Porting Form and CAF along with requisite documentary proof to the mobile service provider.
  • If you are a postpaid subscriber, submit a paid copy of the last bill issued along with the Porting Form and CAF.
  • Obtain a new SIM card from the new service provider. ( Service provider may charge porting charge maximum up to Rs.19/- + GST) .

Though most of the Banks have installed Tools and Procedures like i) Image and Phrase selection of your choice, ii) OTP - one time Password, iii) Registration of third-party payee within the Bank, NEFT and RTGS and confirmation thereof through OTP.

Introducer Not Liable For Frauds by Account Holder

In a significant judgment, the Supreme Court has held that an introducer, without other evidence, could not be held liable for a fraud played on the bank by an account holder. 
 
Earlier, the introduction was a necessary and sufficient condition for opening an account. But following this judgment introduction will only be a necessary condition but not sufficient to open an account. As the introducer’s liability is now limited, banks, as part of the ‘know your customer’ norms, will have to conduct stringent background checks on prospective account holders. 
 
Jamshedpur-based Manoranjan Das, a businessman having a current account in Central Bank, had introduced one Loknath Acharya to the bank on May 26, 1972, for the purpose of opening a similar account. 
 
Acharya on October 30, 1972, presented three demand drafts - one for Rs 32,000, second for Rs 78,000 and the third for Rs 90,300. After presenting the demand drafts, he presented a self cheque of Rs 27,000 and withdrew the money. Little later, he presented another cheque of Rs 1,40,000 for withdrawal. 
 
By now the bank manager became suspicious and on verification, it was found was out that all the three drafts were forged ones. But, by then the culprit had fled. 
 
The bank filed a complaint with the police accusing Acharya and Das, who had introduced him, to have cheated the bank to the tune of Rs 27,000. And the trauma began for Das. He was embroiled in litigation for 32 years. 
 
Das was convicted by a trial court for cheating and awarded a punishment of three years imprisonment. The High Court upheld the conviction but reduced the sentence to six months. 
 
Allowing the appeal filed by Das, the Supreme Court said both the trial court and the High Court committed a serious error as Das had introduced Acharya to the bank only for opening an account and “that by itself does not spell out any fraud or cheating.”

DND (Do Not Disturb) Telecom Commercial Communications Customer Preference Regulations 2010

Customers- Customers (landline and mobile) who do not want to receive commercial communications can dial or SMS to 1909 (toll-free) and register in either of the two categories:

Fully Blocked Category- stoppage of all commercial Calls/SMS
.
Partially Blocked Category- stoppage of all commercial Calls/SMS except SMS from one of the opted preferences.

For registering option using SMS, for 'fully blocked category', write "START 0" and send it to 1909.
For 'partially blocked category',send SMS 'START' with one or multiple options from the list of seven categories.There are at present 7 preferences to choose from :

Banking/Insurance/Financial Products/Credit Cards-1, 

Real Estate-2, 

Education-3,

Health-4,

Consumer goods and automobiles-5,

Communication/Broadcasting/Entertainment/IT-6, 

Tourism-7.

For example: To receive messages relating to only Health products, then send SMS "START 4" to 1909. Similarly, for receiving messages relating to Real Estate and Education, send SMS "START 2  or  3" to 1909.

On successful registration, the customer will receive an SMS confirming exercised options and a Unique Registration Number within 24 hrs. The registration will be effective within 7 days of placing the request with the service provider. The customers can check the status of their Registration Status OnlineThe customer can also change the preferences after 7 days of registration or the last change of preference. If the customer receives Unsolicited Commercial Communication (UCC) even after 7 days of registration, he can register a complaint with his service provider within 3 days of receipt of such UCC by dialing or sending SMS to 1909. Customers will have to provide the telephone number or header of the message from where the call or message has been received, short description of such call or message along with the date and time.

For complaint through SMS, the customer has to send SMS "COMP TEL NO XXXXXXXXXX; dd/mm/yy; Time in hh: mm; short description of Unsolicited Commercial Communication" to 1909. Where XXXXXXXXXX - is the telephone number or header of the SMS, from which the UCC has originated.

Service Provider will take action on the complaint and inform the complainant within 7 days of lodging of the complaint. Customers may check UCC Complaint Registration Status Online.

Neither Follow Nor Share - Social Networking - Virtual World

Modern World is the virtual world on the web. There is lot of classified and unclassified information on the web.All Social Networking Sites are spreading their wings and to spread a rumour, gossip and event - no effort is required .Governments all over the world are duty bound to protect their citizens from unwanted, illegal content which can spread haterdness  sex,violence,   or unauthenticated information which can harmful for Society. But can we stop it ?

Answer is big "NO" as the Governments all over the world do not have the Will Power to control Social Media, may it be any form. There seem to be no Law to restrict or discipline the Social Media so that future generations are not misled by content spreading on the web. Every Website, Blog showing any legal or illegal, violent or non-violent, porn videos or tutorial videos have the above social plugins and buttons displayed on their sites.

Tweet this, Like us on Facebook, Follow on Google+, Email this, Share this through hundreds of sharing gadgets like pintrest, stumble upon .But why the websites or blogs ask for Like Us, Follow Us and Share this and put in Social Plugins in such a way that one is prompted to or accidently clicks on Pop-in windows and once the content gets shared it gets multiplied geometrically as such sharing can be activated by audience in the age group 13+ and above.In my opinion we can protect the future generations from ill effects of the virtual world if we collectively follow the under noted guidelines:

Facebook and all other Social NetWorking sites must not allow their Social Plugins to be installed on websites, blogs and videos displaying illegal content and content harmful to the Society. Moreover these social networking sites must not permit more than one Profile ID or Fake ID's .Even Google and Yahoo sites must not permit more than one Email ID and that too be also permitted after it gets verified from a genuine source of information (verifiable online) like Passport Number, Voter Card No., Social Security Number, Visa Credit Card Number, Unique ID Number, Permanent Income Tax Account Number, Driving License Number and above all through valid IP Address of the PC/Laptop/Mobile Connection duly verifiable and registered in the name of the Individual who is creating the ID.Now the question is that,we , as a civilized society will like the under privileged also to be a part of modernized developed world. How can be achieve it .The social networking sites or Google and Yahoo like services providing email ID's can ask the New Profile ID seekers to provide a reference of existing verified Email ID to whom email may be sent for verification and after verification only the new Profile ID may be allowed to be created/activated. When a person is asking for a Google/Facebook/Yahoo Profile - I think he or she must be having at least one friend or family member who can vouch for his/her antecedents. 

It is never too late to start a noble idea to protect the future generations from  ill effects of Virtual World and the Governments world over need to show their will power by bringing about changes through legislative measures as CyberCrime and online Impersonation will be biggest challenge in the near future.

Above all - ask one question to yourself - while clicking Like Us, Follow Us, on Facebook, Google Circles, Tweet this, Retweet this, if the site and the author of the article is a verified Google Author and has passed through all the litmus tests to get verified. You may not have any valid reason and you can not track the future personality of the Person or reliability of the website and your liking and following will make the person or website popular among your Google/Yahoo Circles and Facebook friends. Even if they change the content of the website or authored article, your Liking will remain in tact though you may not like the changes made. How can we deal with this situation? First of all the Social Plug ins and buttons when clicked must prompt the visitor for "Reasons for Liking/Following - predefined reasons or Others." and also ask for "Expiry Date or Permanent Liking" of such liking or following as Liking/tastes/followings go on changing over a period of time. All such Social Plugins and buttons must have Expiry Date -I,mean to say that in case the person who initially liked/followed/shared/tweeted an individual's philosophy or a product or a website/video - if that very person does not make any contact with the individual/Product/Website/Video/Place/Service Center - the analytic's and statistics of Number of Likes, Google Followers must get automatically reduced so as to depict the true statistics of Likes/Followers in the current situation. These steps will reduce the incidence of misleading audience i.e. the virtual word. 
                  
Note : This article was written by the author on 06th of November 2012 but and Facebook and Social Networks have started thinking on the same lines as about a month back when the author forgot the password to sign in Facebook account, the Facebook asked to get the email verified through a friend's email. This post is being updated by the author today on 10th of Nov.,2014 as the author is of the considered opinion that later or sooner national governments all over the world will ensure that social networks do not become the rulers on the web and they check national ID's of their users. There is no harm in doing so. Let us make the world to adopt the policy to Speak Truth and Forget so that the world wide web becomes more and more reliable. In my opinion the statistics of liking should be reversed if the person, who liked, does not revisit the article, page or website. Moreover social networks and search engines should also downgrade the Page Rank of the websites who provide Paid Services for buying the "Number of Likes" as I am flooded with mails asking me utilize their services for Paid Up Likes on Google+, Facebook and other social networks for petty amounts say just 50 $s for 10000 facebook likes.

EPS AND EPF - Main Social Security Schemes

FOR PUBLIC/PRIVATE SECTOR EMPLOYEES IN INDIA


The Constitution of India under "Directive Principles of State Policy" provides that the State shall , within the limits of its economic capacity, make effective provision for securing the  right to work, to education and to public assistance in cases of unemployment, old-age, sickness & disablement and undeserved want. The EPF & MP Act, 1952 was enacted by  Parliament and came into force with effect from 4th March,1952. A series of legislative  interventions were made in this direction, including the Employees' Provident Funds and Miscellaneous Provisions Act, 1952.  Presently, EPS 1995 SCHEME and the EPF SCHEME 1952 are in operation under the Act:

All the Public/Private Sector employees ,employed not before the commencement of the above schemes, are advised as under :

  1. To keep a track of their EPF contributions along with EPS contributions.
  2. Never to withdraw their EPF contributions when they change employment.
  3. PF account balance  of old employer must be got clubbed with the PF account of new employer so as to retain the EPS account for optimization of the receivable pension at the time of   superannuation/retirement .
  4. Maintain your own MIRROR ACCOUNT for EPF and EPS contributions as small missing credits can have a multiplier effect on the Final PF Balance and receivable PENSION.

Cash Less Corruption Free Society - Demonetization of Currency

Tax Evasion in India
In my earlier articles also I have been impressing upon the need for a Cash Less Society to weed out Corruption from India. The GOI needs strong will Power to go in for Demonetization of Currency as Money Supply has grown to a dangerous level and if not checked - it can be disastrous for the Indian Economy in the long run.

Demonetization of Currency (Last carried out by Late Sh.Morarji Desai the then Prime Minister of India in 1977-78) along with Cash transaction Less Society will yield the following benefits :
  • Expenditure on Printing and Minting of Currency will be reduced to negligible whereas GOI is spending huge budget for import of paper,ink and technology for Security Printing Press in India.
  • Counterfeit Currency is a big challenge for any economy as it increases the money supply without any addition to Gross Domestic Product or National Income and fuels inflation.Govt. has to make huge expenditure on detection and confiscation (by law enforcing agencies like Police, CBI and EOW of the State Governments) of the Counterfeit Currency .By demonetizing Currency  - we will not only be able to check infiltration of fake currency but the Black Money will also come out and can be ploughed back in the Indian Economic System.
  • Only after we demonetize currency - we can arrive at the True Figure of Money Supply in India the biggest source of inflation. As we are not aware of the True figures of money supply - all our efforts ,economic policies yield no results as we are neither able to judge the strength of the Indian Rupee (INR) nor able to frame reliable Fiscal Policy as Black Money in the shape of Cash is also multiplying.
How can we achieve it in India - when we are struggling with Poverty, unemployment, Uncontrolled Inflation, Shelter, Education, Health ,Social
Security and our Leaders are not finding ways and means come out of the vicious circles of the economy.

India is not devoid of Leaders like Indira Gandhi, who had the courage to nationalize the Banking Industry in India in 1969 and a second dose of nationalization of 6 more commercial banks followed in 1980. The stated reason for the nationalization was to give the government more control of credit delivery to the Priority Sector as Private Banks used to look after the interests of Capitalists and ignored the masses and the downtrodden. With the second dose of nationalization, the Government of India controlled around 91% of the banking business of India. Now question is - whether it does not hold good even today.What is the role of the Banks - to regulate flow of surplus credit - from individuals, regions, sectors  to deficient individuals, regions and sectors so that there are no economic imbalance within the society.
  • Anyhow - I am a bit distracted from my motive "How can we achieve it in India" as you will appreciate that Economics is a Complex Subject and it will remain Complex even for the future generations as Human Necessities will go on changing with the passage of time. "Luxury" of today may become "Necessity" of the Future.
  • When India can achieve the feat of "Mobile in Every Hand" why cant we achieve that every Indian has a Bank Account from the date of birth itself linked to the Unique Identification Number to be issued along with the Birth Certificate.
  • Every Indian's  UCIC (Proposed by RBI) w.e.f. 01-04-13 needs to be linked with UID and for all financial transactions inter transfer of funds between the UID's can be a reality through Mobile/ATM networking.

India is not deficient in raw sources but we lack the capability to manage resources which are in plenty. Unclaimed Deposits/ Inoperative Accounts in Banks - Display list of Inoperative Accounts

One Para of our Previous Posts , reads as under : Keeping in view public interest, it had been decided that banks should, in addition to the instructions contained in the above mentioned circular, play a more pro-active role in finding the whereabouts of the account holders of unclaimed deposits/ inoperative accounts. Banks are, therefore, advised that they should display the list of unclaimed deposits/inoperative accounts which are inactive / inoperative for ten years or more on their respective websites. The list so displayed on the websites must contain only the names of the account holder(s) and his/her address in respect of unclaimed deposits/inoperative accounts

Now Some of the Bank Like Andhra Bank have started the Facility  and in case your Bank has not acted upon RBI's advice, one can approach the regulatory body to press upon the Bank to implement the RBI guidelines

When anyone applies for a Loan to the Bank of FI,  CREDIT RATING FOR LOAN APPROVALS BY BANKS AND FI'S is verified by the Bank's and FI's .Similarly verification of Immoveable properties is also investigated/verified/checked by the Bank's or FI's from CERSAI. CERSAI: Central Registry of Securitisation Asset Reconstruction and Security Interest of India is a company licensed under section 25 of the Companies Act, 1956 and registered by the Registrar of Companies, New Delhi.
The Company is a Government Company with a shareholding of 51% by the Central Government and select Public Sector Banks and the National Housing Bank are also shareholders of the Company.
The object of the company is to maintain and operate a Registration System for the purpose of registration of transactions of securitisation, asset reconstruction of financial assets and creation of security interest over property, as contemplated under Chapter IV of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. (SARFAESI Act).
The Registration would be applicable to transactions of security interest over property created to secure loans and advances from the banks and financial institutions as defined under the SARFAESI Act.
The Company is providing the platform for filing registrations of transactions of securitisation, asset reconstruction and security interest by the banks and financial institutions.
Any person can also search and inspect the records maintained by the Registry on payment of fees prescribed under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest (Central Registry) Rules, 2011.
